Grandparents who murdered toddler after campaign of horrific abuse will not have their jail sentences increased

A pair of grandparents convicted of killing their two-year-old grandson after enduring relentless abuse have been denied a longer prison term. The case revolved around the brutal deaths of Ethan Ives-Griffiths, who suffered severe injuries and catastrophic brain trauma before collapsing at his family’s home in Flintshire, North Wales, in August 2021.

Extensive injuries and neglect

Ethan, who was critically dehydrated and emaciated, arrived at his grandparents’ residence with extensive bruising and signs of severe physical neglect. A harrowing post-mortem revealed he had been ‘painfully thin’ at just 10 kilograms and bore more than 40 injuries across his body, alongside devastating brain trauma.

Sentencing and appeal

Michael Ives, 48, received a minimum of 23 years in prison, while Kerry Ives, 47, was sentenced to 17 years. Their sentences were challenged by the Solicitor General’s legal team, which argued they were ‘unduly lenient.’ However, the Court of Appeal in London rejected the appeal, stating the punishments were just and appropriate.

“On behalf of the Solicitor General, Mr Jones contends that for Michael and Kerry the minimum terms of 23 years, and 17 years, respectively, were unduly lenient,” Lord Justice Popplewell noted.

The panel emphasized that the sentencing judge, Mr Justice Griffiths, had clearly considered the circumstances, including the prolonged mistreatment Ethan endured. Among the aggravating factors was a video showing Michael Ives carrying his grandson by the top of his arm and appearing to strike him after placing him in a car seat. Another clip depicted the child walking in the garden with an unsteady gait, possibly linked to earlier head injuries.

“The judge was very well placed to assess her culpability and personal mitigation,” Lord Justice Popplewell added, addressing Kerry Ives’ case.

Mother’s conviction and appeal

Ethan’s mother, Shannon Ives, 28, was found guilty of causing or allowing his death and of child cruelty, receiving a 12-year sentence. Her legal team contested the term, claiming it was ‘too long’ and that the judge overlooked her personal circumstances. The court, however, upheld the decision, asserting the sentences were well-justified.

Ethan’s final appearance was captured at Broughton Retail Park on August 13, 2021, just days before his fatal collapse. The footage showed him seated in a shopping trolley, a moment that highlighted the carefree demeanor masking the impending tragedy.
