Ex Special Counsel Jack Smith Defends Trump Charges

Cyberzenhub.com – Ex special counsel Jack Smith told the Senate Judiciary Committee that he stands by the decisions to bring criminal charges against President Donald Trump. Smith said the cases were based on evidence and law, not Trump’s political party, beliefs, campaign activity, or 2024 candidacy.

His testimony addressed the two federal investigations he led: one concerning efforts to overturn the 2020 election result and another involving classified documents. The hearing came amid continued Republican criticism of the investigations and calls for action against Smith.

I stand by my decisions as special counsel, including my decision to bring charges against President Trump. I made these decisions without regard to President Trump’s political association, activities, beliefs, or candidacy in the 2024 presidential election.

Smith said he would make the same charging decision if comparable facts involved a former president from either major political party.

If asked whether to prosecute a former President based on the same facts today, I would do so regardless of whether that President was a Republican or a Democrat.

Republicans Question Investigation Practices

Senate Judiciary Committee Chairman Chuck Grassley, an Iowa Republican, challenged Smith about financial records obtained during the Jan. 6 investigation. Grassley cited FBI and Justice Department disclosures that he argued showed an improper focus on information connected to Republican organizations.

Smith acknowledged that his office obtained financial information but said he could not recite every subpoena issued during the hearing. He said the requests were part of a criminal investigation into efforts to disrupt the transfer of presidential power after the 2020 election.

Yes, we acquired financial information. As I sit here right now, I cannot recite to you every subpoena we issued. I can tell you why we issued subpoenas and it was to conduct a criminal investigation of one of the most serious crimes that has ever happened in our nation’s history.

Grassley accused Smith’s office of political bias and misconduct. Smith’s supporters, meanwhile, argued that the investigations were necessary to determine whether crimes were committed in connection with the effort to reverse the election result.

Smith Defends His Former Team

Ex special counsel Jack Smith also defended former members of his team after Grassley named several prosecutors who worked on the investigations. Smith said he was proud of their public service and criticized what he described as political retaliation against government employees.

I believe public servants should be protected. The members of my team you just mentioned, I’m extremely proud to have worked with them.

Smith said it was wrong that former colleagues had been fired or otherwise targeted, arguing that their professional and personal lives had been unfairly disrupted.

Sen. Dick Durbin of Illinois, the committee’s ranking Democrat, said Smith had offered to testify nearly a year earlier. Durbin said Democratic senators had repeatedly sought an opportunity for Smith to respond publicly to Republican allegations.

Let me be clear: There was nothing untoward about special counsel Smith and his fellow prosecutors conducting this investigation.
